1. Who this applies to
These Terms apply to all customers, partners, affiliates and users (“you”) who use any MM service, including Workbalance, Raptor, Raptor Coder, Linkedio, Ebiexperts integrations and any future modules.
2. Using our services
When you create an account or use our services, you:
- Get a non-exclusive right to use the services for your business
- Agree not to misuse them (see Acceptable Use Policy)
- Agree to keep your login details secure
- Confirm you have authority if you act for a company
3. Third-party systems and APIs
Our services often connect to external platforms (e.g. Qlik, Power BI, accounting systems, CRMs, LLM providers). You are responsible for:
- Owning and managing those third-party licences
- Configuring access and security there
- Understanding their terms and costs
We are not responsible for downtime, changes, bugs, security incidents or data loss caused by those third-party systems.
4. AI, automation and outputs
Some services use AI and automation (e.g. Raptor, Raptor Dojo, Raptor Coder, Linkedio automations). This means:
- AI outputs are suggestions, not facts
- MM does not warrant that they are accurate or complete
- You must validate all outputs before use
- You remain fully responsible for any decisions made from these outputs
5. Professional services vs automation
- Professional Services = human consulting, governed by the Professional Services Agreement
- Automation / AI = platform features governed by these Terms
AI/automation outputs are not “deliverables” unless explicitly defined in a Statement of Work.
6. Data ownership
- You own your data
- We own our platforms and tools
- You give us permission to process your data only to provide and improve the services, as described in the Global Privacy Policy and Data Processing Addendum
7. Fees and billing
Fees, billing cycles and payment rules are explained in the Payment and Billing Policy. By using paid features you agree to that policy.
8. Limits of liability
We will provide services with reasonable care and skill, but we:
- Cannot guarantee 100% uptime or perfect AI outputs
- Limit our financial liability to the fees you paid us in the last 12 months
- Exclude liability for indirect losses like lost profits, lost revenue or business interruption, as far as the law allows
9. Governing law and disputes
Our services and these Terms are governed by South African law, with disputes handled as explained in the Complaints and Dispute Resolution Procedure.
